These Terms & Conditions govern the purchase of products and services from Irresistible Cakes (iCakes).
By placing an order online, by telephone, by email, or in person, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not place an order.
All prices are listed and processed in Canadian Dollars (CAD) unless otherwise stated.
Minimum 50% deposit for Woodbridge location pickup, 100% payment for other locations pickup and delivery
Minimum 30% deposit
For wedding cakes, large celebration cakes, and event orders requiring delivery, the remaining balance must be paid no later than fourteen (14) days prior to the event date unless otherwise agreed in writing.
For pickup orders from our main location, any outstanding balance may be paid at the time of collection.
Accepted payment methods include Visa, Mastercard, American Express, Debit, Cash, and E-Transfer. Irresistible Cakes reserves the right to refuse, cancel, or suspend any order for non-payment, suspected fraud, pricing errors, or other reasonable business grounds.
Submission of an order request does not constitute acceptance of the order.
Irresistible Cakes reserves the right to decline any order at its sole discretion. If an order cannot be fulfilled, any payment received will be refunded in full.
All custom cakes and specialty products are created based on the information, instructions, and approvals provided by the customer.
Reference photographs, inspiration images, sketches, and examples are provided for guidance only and do not guarantee an exact replica.
Due to the handmade nature of custom cakes, reasonable variations in colour, decoration, finishing techniques, edible printing, texture, and overall appearance may occur.
Such variations shall not be considered defects and do not qualify for refunds, credits, or replacements.

Requests to modify an order may be accepted at the sole discretion of Irresistible Cakes.
Modification requests submitted within 14 days of the scheduled pickup or delivery date may be declined due to production schedules, ingredient procurement, and operational limitations.
Any approved modifications must be confirmed in writing.
Cancellation requests, refund eligibility, store credits, and quality-related claims are governed by our Refund Policy.
By placing an order, you acknowledge and agree to the Refund Policy published on our website, which forms part of these Terms & Conditions.
Delivery dates and estimated delivery windows are provided in good faith but are not guaranteed.
Irresistible Cakes (iCakes) shall not be liable for delays resulting from:
For wedding cakes and large event orders, delivery may occur within an agreed delivery window rather than at a specific time.
Customers are responsible for ensuring that a designated recipient is available to accept the order at the agreed location.
Orders delivered through third-party delivery providers are subject to the policies and handling practices of those providers. Irresistible Cakes shall not be liable for loss, delay, or damage occurring after custody has been transferred to a third-party carrier.
Certain orders may include rented equipment, including but not limited to cake stands, columns, pillars, fountains, display structures, and decorative accessories.
A refundable security deposit may be required.
Equipment remains the property of Irresistible Cakes at all times and must be returned to our Woodbridge location in the same condition in which it was supplied.
Failure to return rented equipment within the agreed timeframe may result in forfeiture of the security deposit and additional replacement charges.
Irresistible Cakes operates in accordance with applicable food safety regulations and public health requirements.
Our facility does not use any nuts including peanuts or tree nuts in production. While strict procedures are followed to reduce the risk of cross-contact, no facility can guarantee the complete absence of trace allergens.
Customers with food allergies or dietary restrictions are responsible for notifying us before placing an order.
Dietary claims, including but not limited to eggless, gluten-free, vegan, lactose-free, and halal-friendly products, are prepared according to the information available at the time of production.
Customers who provide photographs, logos, artwork, trademarks, or other content for edible image printing represent and warrant that they possess the necessary rights and permissions to use such content.
Irresistible Cakes shall not be responsible for any copyright, trademark, licensing, or intellectual property claims arising from customer-supplied materials. Printed edible image colours may vary from digital files or printed originals.
Unless requested otherwise in writing before production, Irresistible Cakes may photograph completed cakes and use those images on our website, social media, marketing materials, and advertising. By placing an order, you consent to this use.
Customers are responsible for following all storage, transportation, handling, and serving instructions provided by Irresistible Cakes.
Irresistible Cakes shall not be responsible for deterioration, damage, or product quality issues resulting from improper handling, storage, transportation, or environmental conditions after pickup or delivery.
Certain cakes may contain non-edible structural components, including wooden dowels, floral wires, plastic supports, separators, and decorative accessories.
Customers are responsible for ensuring that all non-edible components are removed prior to serving.
Irresistible Cakes shall not be liable for injuries, damages, or losses arising from the consumption or misuse of non-edible components.
All website content, product photography, cake designs, logos, graphics, text, and branding materials are the property of Irresistible Cakes and are protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, or used without prior written consent.
By providing your phone number or email address, you consent to receive transactional communications from Irresistible Cakes, including order confirmations, appointment reminders, delivery updates, pickup notifications, next year's order reminders, and customer service communications by SMS, WhatsApp, phone call, or email.

Personal information is collected, used, and protected in accordance with our Privacy Policy.
To the maximum extent permitted by law, the total liability of Irresistible Cakes arising from any claim, dispute, or cause of action shall not exceed the amount paid for the applicable order.
Irresistible Cakes shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, event disruption, venue expenses, travel costs, replacement purchases, or business interruption.
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
Irresistible Cakes reserves the right to modify, update, or replace these Terms & Conditions at any time without prior notice.
Updated versions shall become effective upon publication on our website.
Irresistible Cakes does not sell, rent, trade, or share customer personal information with third parties for their marketing purposes. Customer information is used only for order processing, customer service, communications, and business operations as outlined in our Privacy Policy.
Where Irresistible Cakes determines that a significant error has occurred due to our fault, including but not limited to the wrong cake being supplied, an incorrect custom message, substantial deviation from the approved design, or failure to provide the ordered product, a store credit, partial refund, or full refund may be issued.
As a condition of refund review, customers may be required to return the product to our Woodbridge location for inspection.
We charge 13% of your order for service charges.
We charge 13% HST for delivery.
Delivery fees, setup fees, service charges, rental fees, and other applicable charges may apply depending on the order type, location, and services selected.
Such charges will be disclosed during the ordering process whenever possible.
Payments are processed through secure third-party payment providers. Irresistible Cakes does not store complete credit card information on its servers.
Reasonable administrative, technical, and physical safeguards are used to protect customer information.
Irresistible Cakes offers multiple pickup locations throughout the Greater Toronto Area and Southern Ontario.
Except for our main location at 4040 Steeles Ave West, Woodbridge, Ontario, pickup locations may be operated by independent businesses and may be changed, relocated, or discontinued without notice. Customers will be notified if any such change affects an existing order.
